DEFINITIONS
§ 1


Whenever these Regulations refer to:

 

Seller (Iep24 Sp.J) – it should be understood as Iep24 Sp.J with its registered office in office in Radwanowice at 21 Lipca 38, 32-064 Rudawa entered into the register of entrepreneurs kept by the District Court for Krakow - Śródmieście in Krakow, XI Commercial Division of the National Court Register; KRS number 0000494481; EU VAT PL5130236726;


Store - it should be understood as the online store run by the Seller at www.iep24.eu 

Goods - it should be understood as equipment offered by the Seller, such as computers, printers, electronic accessories, lighting products, radio and TV equipment, heaters, boilers, water pumps 

Buyer – it should be understood as a natural person, including a consumer, a legal person and an organisational unit with legal personality conferred by the Civil Code;

Consumer – it should be understood as a natural person entering into legal transactions not directly related to its business or professional activity.

Regulations – it should be understood as this document.

 

GENERAL PROVISIONS

 
§ 2


1. Regulations specify the rules under which the Seller sells Goods via the Store to Buyers. 
2. Seller declares that in relation to the Consumer it shall care for the compliance of the Goods with the agreement, ensure their standard quality and compliance with the parameters, features, appearance and other characteristics that have been specified in the description of Goods

SUBMISSION AND ACCEPTANCE OF ORDERS 


§ 3


1. Buyer shall place an order through:

a) prior logging in to the Store,

 
b) selection of one or several items from the Goods available at the Store;
c) correct completion of the electronic form available in the Store;
d) sending the electronic order form from the Store’s website.

2. The order shall be considered placed if the form includes all the data required to correctly identify the Buyer, in particular, address, contact phone number or e-mail address.
3. The order shall be executed only after it is confirmed by phone or e-mail by an employee of Iep24 Sp.J Likewise prices, until confirmed, are for information purposes only.

4. In case of inability to execute the order within the period specified in the Regulations due to lack of Goods ordered or insufficient quantity of Goods, the Seller shall immediately, by telephone or e-mail, notify the Buyer of this fact and propose another order execution deadline, which shall in each case be confirmed by e-mail sent to the Buyer. If the Buyer accepts the proposed changes, he/she shall immediately send confirmation e-mail with the following or similar content "I acknowledge I have received agreement terms and I accept them".  The Buyer shall be entitled to not accept the new deadline for the execution of the order. No e-mail from the Buyer, confirming the proposed terms of agreement, shall be considered as the lack of consent, thereby cancelling the order. 


In this case, neither party shall be liable for non-fulfilment of the order.


5. In case of unavailability of the Goods, the Seller shall, by telephone or e-mail, notify the Buyer of this fact. 


In this case, neither party shall be liable for non-fulfilment of the order.

Execution of orders

 
§ 4


1. Execution of orders for Goods shall take place within 2 (two) business days from the time of the sending of the order confirmation from the Seller to the Buyer. 
2. The execution period shall not include the day on which the Seller transferred the order confirmation to the Buyer.

 

3. For reasons beyond Seller's control the order execution deadline referred to in paragraph 1 may be extended. The Seller shall inform the buyer of the reason for the extension of the deadline and estimate a new deadline. 



4. Detailed rules for the execution of orders for specific Goods shall be included in their descriptions.

 

Rules for Delivery of Goods 


§ 5


1. Seller shall deliver the ordered Goods in the manner indicated by the Buyer in the order form.

2. Deliveries shall be made via a shipping company. It is also possible to receive deliveries by Poczta Polska. Such deliveries are cheaper, but there is a shipment weight limit (usually up to several kilograms) and a longer delivery time.

3. If it is necessary to select another shipping company (e.g. one that the Buyer has a contract with), this should be indicated at the time of placing the order.

4. In case the Buyer's registered office or place of residence is outside Poland, the Seller, upon confirmation of the order, shall inform the Buyer about the amount of fees due for the delivery of the ordered Goods and send him a pro forma invoice, on the basis of which the Buyer shall make the payment. Upon receipt of the money, the Seller shall deliver the ordered Goods to the Buyer in the manner indicated in the order.

5. Buyer when placing an order in the Store can choose a shipping company. In the administrative area of Krakow the Goods shall be supplied free of charge (when the order exceeds PLN 300 net).

7. The conformity of the delivery with the order must be verified in the presence of the courier. Any deficiencies must be reported to the Seller within 24 hours. In case damage to the shipment is detected, it is advisable to write down a damage protocol with the courier.

METHODS OF PAYMENT, VAT INVOICES

§6

1. Payments for the ordered Goods can be made directly to the courier during delivery or by a bank transfer (confirmed prepayment) to the bank account of the Seller.

2. The Buyer with the Regular Customer status shall also be allowed to pay by bank transfer upon receipt of the Goods.

3. Payment for the Goods must be made to the company account:

4. The Customer shall receive an invoice or receipt for the purchased Goods together with the Goods.


WITHDRAWAL FROM THE AGREEMENT AND RULES OF RETURN OF GOODS 
§ 7


1. If the Buyer has the status of Consumer within the meaning of Article 22¹ of the Civil Code, then he/she is entitled to withdraw from the agreement within 14 days.

2. For other Buyers that do not have the status of Consumer, rules and terms of withdrawal are governed by the Civil Code.

3. The Consumer can withdraw from the agreement, without specifying the reason, with a statement. The statement may be made with the use of the template  attached as Appendix 1 to the Regulations. Seller shall promptly send the Consumer a confirmation of receipt of the statement of withdrawal from the agreement.


4. In case of an effective withdrawal from the agreement by the Consumer, he/she shall at his/her own expense return the Goods in the unaltered state no later than fourteen (14) days from the date of withdrawal. Due to the size and weight of some Goods, in case of withdrawal, return of some Goods may be associated with higher costs than regular postal mail. The Consumer shall attach to the packaging containing the returned Goods the sales document received from the Seller and a letter indicating the bank account number, which the money is to be returned to. The reimbursement of the price paid by the Buyer shall be made in a manner specified by him/her within 14 days from the date of arrival of the Goods returned by the Buyer. The fees for the delivery of Goods ordered and paid by the Consumer on receipt of the Goods are not subject to reimbursement, if the Consumer has chosen a method for delivery of Goods that was different than the cheapest standard delivery method provided by the Seller.

5. The Seller reserves the right to pursue claims against the Consumer for any diminished value of the Goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Goods.

PLACE AND METHOD OF SUBMISSION OF COMPLAINTS


§ 8


1 Consumer can file a complaint:

a)      by letter to: Iep Sp. J ul. Czerwonego Prądnika 2C 31-431 Kraków;

b)      by e-mail to office@iep24.eu

 2. The complaint should state the reason for its submission and the scope of activities, the performance of which the Consumer expects from the Seller, and the bank account number, to which, if the complaint is accepted, the Seller is to reimburse the Buyer for the price of Goods or for the cost of delivery of the Goods.

 
3. Seller shall consider only written complaints (sent by mail, fax or e-mail) within 7 working days from the date of their submission by the Consumer.

 
4. If the complaint concerning defects in the delivered Goods is accepted by the Seller, the Consumer shall return the defective Goods to the address of the Seller incurring standard delivery costs. In this case, the Seller shall deliver new non-defective Goods to the Consumer in accordance with the rules set out in these Regulations. In case the delivery of new non-defective Goods is not possible the Seller shall reimburse the price to the Buyer.

5. In the event that the Seller refuses to accept the complaint relating to the Goods or delivery, the Consumer shall have the right to pursue claims in the courts or amicably, for example, through out-of-court arbitration.

WARRANTY

§ 9

1. Together with the proof of purchase the Buyer shall receive a warranty for the purchased Goods. Such a warranty, depending on the type of Goods, is stuck to the original product packaging or provided as a separate document.

2. Implementation of the manufacturer's warranty (e.g. HP printers, digital cameras, etc.) is carried out in the manufacturer's Authorised Service Centres across the country.
Information about Authorised Service Centres can be found on the printed warranty and the manufacturer's website.

3. Implementation of the warranty issued by Iep24 Sp.J is performed at the company headquarters. The claimed product must be delivered at the Consumer's expense to the following address:

4. The Consumer's rights under the warranty issued by the Seller expire automatically: once the warranty period expires; in case the Goods or any of their parts were changed, modified, supplemented or replaced by the Consumer or entity other than the Seller; in case the Goods were operated in a manner inconsistent with their purpose and directions of the Seller and manufacturer of the Goods;

 
in the absence of proper maintenance of the Goods in accordance with the instructions of the Seller; in case of damage or defect of the Goods that occurred as a result of: harmful radiation, any mechanical shock, electrical malfunction; in case of a breach, damage or breaking of seals or serial numbers of the Goods or if they are covered in any way that makes the identification of the Goods impossible.

5. In case damage to the shipment is detected, it is advisable to write down a damage protocol with the courier that facilitates the consideration of the warranty complaint.
Getting in contact with the Seller is recommended prior to the writing down of the protocol.

6. NOTE: Before sending the Goods to Iep24 Sp.J, it is recommended to notify the intention by telephone.

7. Notification of defects in the Goods by the Consumer and the initiation of a complaint procedure takes place upon receipt by the Seller of the Consumer's damaged goods statement and of the defective goods. Seller considers the claims relating to the warranty within 14 working days of their receipt. If it is necessary to send the defective goods or parts thereof to specialised services the time needed to process a warranty claim may be extended to 28 working days.

8. Seller shall have no obligation to provide the Consumer with a replacement product for the duration of the complaint procedure.

9. Consumer shall provide the defective Goods to the Seller in original, factory packaging, in which the goods were received by the Consumer, including all elements provided to the Consumer, in particular, documentation, drivers, cables. The Consumer shall be allowed to deliver the defective Goods in a replacement packaging, which provides an adequate level of protection of Goods during transport.

10. The rights under the warranty issued by the Seller to Buyers who do not have Consumer status are excluded.

FINAL PROVISIONS

§ 10


1. If the Buyer has the status of a consumer within the meaning of Article 22¹ of the Civil Code the provisions of the Act of 24 June 2014 on the Rights of Consumers apply to the sale of Goods in the store, as long as it does not result directly from the wording of the Regulations. These Regulations are available on the Seller's website.

2. It shall be presumed that the Buyer when placing an order familiarised himself/herself with these Regulations and that he/she accepts their content.

3. All collected data of the Buyers are intended solely for the purposes of the order execution and will not be shared with third parties. All Buyers shall have the ability to view and edit their data. The Buyer shall also decide whether he/she wants to receive newsletters from the Store.

4. The Buyer making purchases at the Store agrees to transfer his/her e-mail address to Allegro Group Sp. o.o. with its registered office in Poznan and to the processing by Iep24 Sp.J and Allegro Group Sp. o.o. of Customer's personal data in order to complete the survey of the opinion on the transaction at the Store and to confirm that the transaction is covered by the Buyer Protection Programme (in accordance with the provisions of the Law on Personal Data Protection of 29 August1997)

5. Store uses 'cookies' (text files stored on the client computers) in order to improve the quality of services, and in particular the maintenance of user sessions.

6. We reserve the right to change these regulations. The changes made are effective when accepted by the customers upon logging in.

7. Use of this site constitutes acceptance of these Regulations.

8. Any claims arising from the operations of the Store shall be governed by the Polish law and any disputes shall be resolved before the appropriate court in Poland.

9. The provisions of these Regulations shall apply to the orders placed by telephone and by e-mail.

ENTRY INTO FORCE OF THE REGULATIONS

§ 11


The Regulations come into force on 25 December 2014 and apply to all orders placed after that date.
